Per reporting from the Chicago Sun Times, Tchen, reportedly at the request of Smollett’s family, texted Cook County state Online Cigarettes Store USA attorney Kim Foxx to ask that she persuade Chicago Police Department superintendent Eddie Johnson to turn Smollett’s case over to the FBI. Tchen claims she made the request out of a desire to prevent media leaks.

Just days after Smollett claimed the crime had occurred, Foxx replied to Tchen saying she had made her case to Eddie Johnson, who ultimately refused to relinquish control over the probe.

“OMG this would be a huge victory,” Tchen wrote in response to a text message from Foxx. “I make no guarantees,” Foxx answered, “but I’m trying.”

Foxx later recused herself from the case, a move that prompted a letter from the Chicago Fraternal Order of Police asking the Department Newport Pleasureof Justice to open an investigation into Foxx’s handling of the situation. In June, a Chicago judge appointed a special prosecutor to look into the matter and suggested that Foxx acted improperly in her decision to hand over the case to a top deputy.

Michelle Obama took to Twitter to celebrate the announcement.

The U.S. Supreme Court on Monday declined to hear Amazon.com's bid to avoid a lawsuit seeking to ensure that warehouse workers for the e-commerce giant get paid for the time it takes them to go through extensive post-shift security screenings.

The justices, on the first day of their new term, turned away an appeal by Amazon and a contractor of a lower court ruling reviving the workers' claims under Nevada state law. The decision comes five years after the Supreme Court issued a ruling in the case that barred similar claims under federal law.

A group of Amazon warehouse workers who package and ship merchandise filed a proposed class action lawsuit in 2010 against Newport 100s Box the contractor, Integrity Staffing Solutions, which provides some of the hourly employees for Amazon.

The workers sought compensation for submitting to what they called mandatory "post-9/11 type of airport security" screenings that are aimed at preventing employee theft. The workers have said the screening takes around 25 minutes to complete.

Amazon called the plaintiffs' description of the protocol "grossly inaccurate" in court papers.
